This matter came before the Court upon the Motion of Defendant Viacom Inc.

("Viacom") to Defer its Obligation to Respond to Plaintiffs' Amended Complaint Until Sixty (60) Days After the Court Rules on the Pending Summary Judgment Motion

IT IS HEREBY ORDERED this Monday of Pepsi) 2003, as follows:

1. Viacom's motion is GRANTED.

2. Viacom shall not be required to answer or otherwise respond to plaintiffs' amended complaint until sixty (60) days after the Court rules on the pending summary judgment motion filed by the federal defendants, and joined on limited basis by Viacom, pursuant to the Court's November 12, 2002 Order.
